Welcome to Asian Airlines . Asian Airlines provides subscription services, providing site visitors and Subscribers with access to aviation employment information. Our services and solutions include searchable job postings, resume database, recruitment media solutions throughout our network and other career related content. Job seekers can search job postings and post a resume on each of our career websites for a fee. Asian Airlines also offers premium career services at a fee to job seekers, such as enhanced resume services. Companies pay to post jobs, search our resume database, and utilize career site hosting and other services. We've put together some detailed terms and conditions. You should read and understand them as they govern your use of our service. These Terms of Use are also a resource for you to get a deeper understanding of how our service works, including the kinds of data we collect, the way we bill, how we interact with you and other useful details about our services. We encourage you to revisit these Terms of Use when you have a question about the service or want to know how something works. For your convenience, we've indexed the Terms of Use so you may easily navigate and access areas of interest. We hope you enjoy your Asian Airlines experience. Please note that these Terms of Use include embedded hyperlinks that may be accessed only through our website.
Acceptance of Terms of Use
You must read and agree to the Asian Airlines , Inc. Terms of Use before you can use Asian Airlines , Inc. (Asian Airlines .com) as they govern your use of our site and services. Please read them completely. The Asian Airlines service is provided by Asian Airlines , Inc., or one of its affiliated companies.
These Terms of Use, inclusive of our Privacy Policy and End User License Agreement ("EULA") govern your use of the Asian Airlines service, including all features and functionalities, email service, our website and user interfaces, and all content and software associated therewith the Asian Airlines service. By visiting, browsing or using the Asian Airlines service, you accept and agree to be bound by these Terms of Use. If you do not agree to these Terms of Use, you should not use the Asian Airlines service, including our website and user interfaces.
By using and visiting the Asian Airlines .com web site you acknowledge and agree that (1) You have read the Terms of Use; (2) You understand it; (3) you are bound by the Terms of Use; and (4) Asian Airlines might update Terms of Use at any time. As used in these Terms of Use, "Asian Airlines service," "our service" or "the service" means the service provided by Asian Airlines . Asian Airlines is providing the service to you (referred to as "Asian Airlines " in these Terms of Use) and with whom you are entering into this agreement.
Changes to Terms of Use
Asian Airlines reserves the right, from time to time, with or without notice to you, to change these Terms of Use, including the Privacy Policy and EULA, at our sole and absolute discretion. The most current version of these Terms of Use can be reviewed by visiting our website and clicking on "Terms of Use" located at the bottom of the pages of the Asian Airlines website. The most current version of the Terms of Use will supersede all previous versions. We will endeavor to post prior version(s) on our website when the Terms of Use are updated.
Refund Policy
All sales of services are final and are nonrefundable.
No refunds are given for services rendered, "no shows" or "non-use" of services. Services, fees and recurring payments are non-refundable and are not prorated. Membership fees are non-refundable (except as required by applicable law). Any set-up fee and/or promotional rates offered are non-refundable.
Asian Airlines offers and provides service for a fee. Once job postings and resumes have been submitted, published, distributed etc., Asian Airlines takes no responsibility for job posting and resume copy, responses, or any lack of response. Prices offered may change at any time, and the Terms of Use do not provide price protection or refunds in the event of a price reduction or promotional offering.
If Asian Airlines technical problems prevent or unreasonably delay delivery of your service, your exclusive and sole remedy is replacement or extension of the service, as determined by Asian Airlines .
Cancellation
Ongoing Membership and Cancellation
Your Asian Airlines membership will continue in effect unless and until you cancel your membership or subscription or the account or service is otherwise suspended or discontinued pursuant to these Terms. You must cancel your subscription before it renews each Billing Period in order to avoid the next billing.
You may cancel your Asian Airlines service at any time. Your account and service will remain open until you cancel using the appropriate cancellation method required for your account/service type as indicated below.
Applicant/Job Seeker/Candidate Services:
Asian Airlines is a self-service system and it is required that service is self-cancelled by logging into your account and completing and submitting the secure self-cancellation form. By submitting the secure self-cancellation form, service will be cancelled, your future automatic recurring payments will be stopped, and you and Asian Airlines will have proper record of your time and date stamped cancellation request. After receiving the on-screen, time and date stamped cancellation confirmation, your resume will be removed from the active applicant pool and Asian Airlines will no longer promote you as an active applicant. If you have not been presented with the on-screen confirmation page, you have not completed the self-cancellation process and your account will remain open and active until the process is complete and on-screen cancellation confirmation is presented. There are no administrative fees when cancellation is submitted using the self-cancellation form provided inside your account. Due to large volumes of bulk, spam and junk email, service cancellations are not processed via email, through the Asian Airlines Help Desk, by fax or by phone. If it becomes necessary for Asian Airlines to cancel your service for any reason, a fee may be assessed as described in the Fees section of these Terms of Use.
You may retrieve your login credentials on the Applicant Sign In web page 24 hours a day, 7 days per week so that you may securely close your account at any time.
Employer/Recruiter/Company/Agency Services:
Service must be self-cancelled verbally through an Asian Airlines representative via phone. You must notify Asian Airlines of your intent to cancel by phone at least five (5) business days prior to your next recurring payment due date. Email requests to cancel do not constitute acceptance of any cancellation. It is imperative that service cancellation is done by speaking with an Asian Airlines representative to ensure account closure and only verbal requests made with an Asian Airlines representative will generate a cancellation request, stop future automatic recurring payments, cancel the service and close out an account. All cancellations are confirmed via email. Due to large volumes of bulk, spam and junk email, service cancellations are not processed via email, through the Asian Airlines Help Desk or by fax.
All advertising product and/or service sales are final and are nonrefundable. In the event of cancellation, Asian Airlines will not prorate any portion of unused service fees, and all outstanding balances and/or invoices must be paid in full. We do not provide refunds or credits for any partial service periods. "Non-use" of services does not constitute cancellation. Cancellation of service does not dismiss any outstanding balance or invoice. Closing an account with Asian Airlines cannot be done by simply canceling the credit card or stopping recurring payments through your credit card or bank. Asian Airlines will continue to treat the account as open and the billing cycle will continue, resulting in a past due account that may be turned over to a third-party collection service.
Disclaimers of Warranties and Limitations on Liability
THE Asian Airlines SERVICE, INCLUDING OUR WEBSITE AND USER INTERFACES, AND ALL CONTENT AND SOFTWARE ASSOCIATED THEREWITH, OR ANY OTHER FEATURES OR FUNCTIONALITIES ASSOCIATED WITH THE Asian Airlines SERVICE, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WE AND OUR LICENSORS MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND WITH RESPECT TO THE Asian Airlines SERVICE, OUR WEBSITE AND USER INTERFACES, AND ALL CONTENT AND SOFTWARE ASSOCIATED THEREWITH. Asian Airlines DOES NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE Asian Airlines SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, AND YOU AGREE THAT Asian Airlines MAY ELIMINATE OR OTHERWISE MODIFY ANY OR ALL ASPECTS OF THE Asian Airlines SERVICE, INCLUDING FEATURES, WITHOUT COMPENSATION OR NOTICE TO YOU. Asian Airlines SPECIFICALLY DISCLAIMS LIABILITY FOR THE USE OF APPLICATIONS, INTERNET ENABLED DEVICES, AND Asian Airlines SOFTWARE (INCLUDING THEIR CONTINUING COMPATIBILITY WITH OUR SERVICE).
Without limiting the foregoing, we and our licensors assume no liability or responsibility for any of the following: (i) errors or omissions in the content delivered by the Asian Airlines service or on the Asian Airlines website or user interfaces; (ii) recommendations or advice of Customer Service; (iii) any failure or interruption in the availability of the Asian Airlines service and/or website or user interfaces, (iv) delivery and or display of any content contained on the Asian Airlines website, user interfaces, or otherwise through the Asian Airlines service; and (vii) any losses or damages arising from the use of the content provided on the Asian Airlines website, user interfaces, or otherwise through the Asian Airlines service itself, including any losses or damages arising from downloading of related software or content, downloading and/or use of any other software, including the remote desktop tool offered by Customer Service, or any conduct by users of the Asian Airlines service, website or user interfaces.
TO THE EXTENT ALLOWABLE BY LAW, WE AND OUR LICENSORS DISCLAIM ALL REPRESENTATIONS AND WARRANTIES, INCLUDING, FOR EXAMPLE, WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. In addition, we do not represent or warrant that the information accessible via our site is accurate, complete or current. We do not make any representations with respect to the content contained on job postings & resumes from the Asian Airlines service or the descriptions of any job posting or resume content contained on our website and user interfaces. We do not represent or guarantee that your use of the Asian Airlines service will be free from interruption, loss, corruption, attack, viruses, interference, hacking, or other security intrusion and we disclaim any liability with respect thereto. No oral or written information or advice given by us or our authorized representative shall create a warranty or otherwise constitute a representation binding upon Asian Airlines or its affiliated parties.
IN NO EVENT SHALL Asian Airlines , OR ITS SUBSIDIARIES OR ANY OF THEIR SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES OR LICENSORS BE LIABLE (JOINTLY OR SEVERALLY) TO YOU FOR PERSONAL INJURY OR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, BUSINESS INTERRUPTION OR ANY OTHER COMMERCIAL DAMAGES OR LOSS, WHETHER OR NOT ADVISED OF THE POSSIBILITY OF DAMAGE, AND ON ANY THEORY OF LIABILITY, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE Asian Airlines SERVICE, OUR WEBSITE AND USER INTERFACES, AND ALL CONTENTS AND SOFTWARE ASSOCIATED THEREWITH, OR OTHERWISE RELATED TO THE Asian Airlines SERVICE, INCLUDING ANY JOB POSTINGS OR RESUMES, FEATURES OR FUNCTIONALITIES ASSOCIATED THEREWITH. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES FOR LOSSES ARISING FROM THE USE OR INABILITY TO USE THE Asian Airlines SERVICE, INCLUDING OUR WEBSITE AND USER INTERFACES, AND ALL CONTENT AND SOFTWARE ASSOCIATED THEREWITH (OTHER THAN AS MAY BE REQUIRED BY APPLICABLE LAW IN CASES INVOLVING PERSONAL INJURY) EXCEED THE AMOUNT OF ONE MONTH'S MEMBERSHIP FEE ON YOUR MEMBERSHIP PLAN. THE FOREGOING LIMITATIONS WILL APPLY EVEN IF THE ABOVE STATED REMEDY FAILS OF ITS ESSENTIAL PURPOSE. IF ANY APPLICABLE AUTHORITY HOLDS ANY PORTION OF THIS SECTION OR OTHER SECTIONS OF THESE TERMS OF USE, INCLUDING ANY PORTION OF THE PRIVACY POLICY OR THE EULA, TO BE UNENFORCEABLE, THEN THOSE PORTIONS DEEMED UNENFORCEABLE SHALL BE SEVERED AND THE TERMS OF USE SHALL BE ENFORCED ABSENT THOSE PROVISIONS AND ANY LIABILITY WILL BE LIMITED TO THE FULLEST POSSIBLE EXTENT PERMITTED BY APPLICABLE LAW.
Asian Airlines MAKES NO REPRESENTATIONS OR WARRANTIES CONCERNING INTERNET ENABLED DEVICES OR THE COMPATIBILITY OF THE DEVICE WITH OUR SERVICE. Additional disclaimers or limitations of liability may be contained in the various third party software end user license agreements you may have agreed to in order to access our service.
Asian Airlines IS NOT AN EMPLOYMENT AGENCY AND NO GUARANTEE OF EMPLOYMENT OR CANDIDATE PLACEMENT IS EXPRESSED OR IMPLIED. Asian Airlines SERVICE IS PROVIDED FOR ENTERTAINMENT PURPOSES ONLY AND IS AN AT WILL, SELF SERVICE. Asian Airlines DOES NOT WARRANT THAT SERVICES, FUNCTIONS AND INFORMATION PROVIDED WILL GUARANTEE APPLICANT OR CANDIDATE INTERVIEWS, PLACEMENT OR ACHIEVE FULFILLMENT OF POSTED VACANCIES.
